When can driving fast be charged as reckless driving in Virginia, whatever the limit?

The rule

Driving 20 mph or more over the speed limit, or faster than 85 mph anywhere, can be charged as reckless driving, a criminal misdemeanor. A fine, a license suspension or jail can follow.

If you drive 20 mph or more over the speed limit, or over 85 mph, an officer may charge you with reckless driving. It's a misdemeanor criminal offense.

From the Virginia Driver's Manual, section 3, page 14. This question is our own wording of that rule. The handbook and the DMV have the final word.
