Can you be convicted of DWI without a chemical test?
The rule
Even without a chemical test, a police officer's testimony about how you drove, looked and behaved can be enough evidence to convict you of intoxicated or impaired driving.
A chemical test isn't required to convict you. A police officer's testimony about your driving, your appearance and how you acted can be enough evidence.
From the New York State Driver's Manual, page 55. This question is our own wording of that rule. The handbook and the DMV have the final word.
