Can you be arrested for DUI if your BAC is below the legal limit?
The rule
If alcohol has impaired your driving, you can be convicted of DUI even with a BAC below 0.08%.
The 0.08% line isn't a safe zone. Impaired driving can bring a DUI conviction with a lower BAC.
From the Virginia Driver's Manual, section 3, page 24. This question is our own wording of that rule. The handbook and the DMV have the final word.
