Practice question · Alcohol and drugs

You are 21 or older and driving your own car. At what BAC is it DUI?

The rule

For a driver aged 21 or more, a blood alcohol content (BAC) of 0.08% or higher counts as DUI.

If you are 21 or older, a BAC of 0.08% or more is DUI. Under 21, a BAC of just 0.02% can bring a conviction.

From the Virginia Driver's Manual, section 3, page 24. This question is our own wording of that rule. The handbook and the DMV have the final word.
