When you drive in Virginia, what have you agreed to if an officer suspects DUI?
The rule
Driving on Virginia's public roads counts as agreeing to a breath test whenever an officer asks (implied consent). After a crash, an officer with probable cause may arrest you for DUI within three hours, without a warrant.
Under implied consent, driving on Virginia's public roads means you have already agreed to take a breath test when an officer asks.
From the Virginia Driver's Manual, section 5, page 30. This question is our own wording of that rule. The handbook and the DMV have the final word.
