Maryland considers a driver to be under the influence of alcohol at what BAC?
The rule
Maryland treats a driver with a blood alcohol concentration (BAC) of .08 or higher as driving under the influence (DUI), and the MVA suspends the license.
A BAC of .08 or higher counts as driving under the influence in Maryland. Lower levels can still affect your driving.
From the Maryland Driver's Manual, Section 6, page 33. This question is our own wording of that rule. The handbook and the MVA have the final word.
