When may you pass a vehicle on the right?
The rule
You may pass on the right only when it's safe and only when the vehicle ahead is turning left, or on a road marked or wide enough for two or more lanes your way with no signs or obstructions against it. Never use the shoulder to pass, or cross the edge line, unless a sign or officer allows it.
Pass on the right only when safe: when the car ahead is turning left, or when the road has room for two or more lanes your way.
From the New York State Driver's Manual, page 39. This question is our own wording of that rule. The handbook and the DMV have the final word.
