In New York, what must an average-size 5-year-old ride in?
The rule
A child under 4 must ride in a federally approved child safety seat. From 4 through 7, a child needs a booster seat used with a lap and shoulder belt, unless the child is over 4 feet 9 inches or over 100 pounds. From 8 through 15, a seat belt is required, though a booster is still advised for a child under 4 feet 9 inches or under 100 pounds.
Under 4: a federally approved child safety seat. Ages 4 to 7: a booster seat used with a lap and shoulder belt. Ages 8 to 15: a seat belt, though a booster is advised for smaller kids.
From the New York State Driver's Manual, page 48. This question is our own wording of that rule. The handbook and the DMV have the final word.
